Article 1 - Scope


General conditions of services


​They are intended to govern the contractual relationship between the company Les Trésors de Mamie and the customer, accepting these general conditions of sale and services.

These general conditions of sale and services specify in particular the conditions of ordering, payment, delivery and withdrawal.

The customer acknowledges having previously read these general conditions of sale and service accepting them without restrictions, and undertakes by validating his order on the site www.lestresorsdemamie.com or by depositing these articles at the workshop. .

The order will be considered accepted and non-retractable, so the buyer accepts these general conditions of sale and services without reservation.

Granny's Treasures reserves the right to modify its CGP at any time. In this case, the applicable conditions will be those in force on the date of the order by the customer.

Article 2 - Orders



2.1 On the online site

​It is up to the Customer to select the Products he wishes to order on the website www.lestresorsdemamie.com, according to the following terms:

The customer chooses a Product that he puts in his basket, Product that he can delete or modify before validating his order and accepting these conditions of sale.

He will then enter his contact details or connect to his space and choose the delivery mode.

After validation of the information, the order will be considered final and will require payment from the customer according to the terms provided.

Product offers are valid as long as they are visible on the site.

The sale will only be considered valid after full payment of the price.

It is the Customer's responsibility to verify the accuracy of the order and to immediately report any errors.

Any order placed on the site www.lestresorsdemamie.com constitutes the formation of a contract concluded at a distance between the Customer and the Seller.

The Seller reserves the right to cancel or refuse any order from a Customer with whom there is a dispute relating to the payment of a previous order.

The Customer will be able to follow the progress of his order on the site.

Article 3 Bis - Customer area - Account


In order to place an order, the Customer is invited to create an account (personal space).

To do this, he must register by completing the form that will be offered to him at the time of his order and undertakes to provide sincere and accurate information concerning his marital status and his contact details, in particular his e-mail address.

The Customer is responsible for updating the information provided.

He is told that he can modify them by logging into his account.

To access his personal space and order history, the Customer must identify himself using his username and password which will be communicated to him after registration and which are strictly personal.

As such, the Customer refrains from any disclosure.

Otherwise, he will remain solely responsible for the use that will be made of it.

The Customer may also request to unsubscribe by going to the dedicated page on his personal space or by sending an email: to fabienne@lestresorsdemamie.com.

This will be effective within a reasonable time.

In the event of non-compliance with the general conditions of sale and/or use, the site www.lestresorsdemamie.com will have the possibility of suspending or even closing a customer's account after formal notice sent electronically and which has had no effect. .

Any deletion of an account, for whatever reason, results in the pure and simple deletion of all personal information of the Customer.

Any event due to a case of force majeure resulting in a malfunction of the site or server and subject to any interruption or modification in the event of maintenance, does not engage the responsibility of the Seller.

The creation of the account entails the acceptance of these general conditions of sale.


Article 4 - Price and Terms of payment


The Products are supplied at the prices in force appearing on the site www.lestresorsdemamie.com, when the order is registered by the Seller.

The prices are expressed in Euros, excluding tax.

Granny's treasures is an individual craft business under the micro-enterprise tax regime:

it is therefore not subject to VAT according to article 293B of the general tax code.

The prices take into account any reductions that may be granted by the Seller on the site www.lestresorsdemamie.com. These prices are firm and non-revisable during their period of validity but the Seller reserves the right, outside the period of validity, to modify the prices at any time.

Prices do not include processing, shipping, transport and delivery costs, which are invoiced in addition, under the conditions indicated on the site when the order is placed.

The payment requested from the Customer corresponds to the total amount of the purchase, including these costs. An invoice is drawn up by the Seller and sent to the Customer by email after delivery of the Products and/or services ordered.

They do not take into account any changes requested by the customer during the process, which will be invoiced in addition.

For payment by credit card, the card is debited only when the Products are sent.

Payments made by the Customer will only be considered final after effective collection by the Seller of the sums due.

The Seller will not be required to deliver the Products ordered by the Customer if the latter does not pay the full price under the conditions indicated above.


Article 5 - Delivery times and withdrawal of the order


5.1 Alteration service

​Delivery times:

Agreed with the customer when ordering.

Storage period 15 days.

With the exception of high-priced clothing (furs, ceremonial clothing, etc. see special stipulations), the items entrusted can remain with the professional for one month, without the latter being able to demand a supplement.

From one to twelve months, the item of clothing may be considered as being placed in custody for payment.

Beyond one year, the couturier may dispose of it by public sale (Law 1248 of 31.12.68).

Any claim in the latter place will be considered inadmissible.

A special provision is made for grand prix garments which, as soon as they are not collected by the date prescribed on the slip, are deemed to be garments to be kept for consideration.

​5.2 Product online

​The Products ordered by the Customer will be delivered in mainland France.

Deliveries are made within 7 days for Products in stock and 7 to 14 days for Products on order to the address indicated by the Customer when ordering on the site.

Delivery is constituted by the transfer to the Customer of physical possession or control of the Product.

Except in special cases or unavailability of one or more Products, the Products ordered will be delivered in one go.

The Seller undertakes to make its best efforts to deliver the products ordered by the Customer within the deadlines specified above.

If the Products ordered have not been delivered within 30 days after the indicative delivery date, for any reason other than force majeure or the Customer's act, the sale may be canceled at the Customer's written request within conditions provided for in Articles L 216-2, L 216-3 and L241-4 of the Consumer Code.

The sums paid by the Customer will then be returned to him at the latest within 14 days following the date of termination of the contract, excluding any compensation or deduction.

Deliveries are made by an independent carrier, to the address mentioned by the Customer when ordering and to which the carrier can easily access. itself, delivery is deemed to have been made upon delivery of the Products ordered by the Seller to the carrier who has accepted them without reservations.

The Customer therefore acknowledges that it is up to the carrier to make the delivery and has no warranty claim against the Seller in the event of non-delivery of the goods transported.

In the event of a specific request from the Customer concerning the conditions of packaging or transport of the products ordered, duly accepted in writing by the Seller, the related costs will be the subject of additional specific invoicing, on an estimate previously accepted in writing by the Customer.

The Customer is required to check the condition of the products delivered.

He has a period of 14 days from delivery to make complaints by email to: fabienne@lestresorsdemamie.com, accompanied by all the supporting documents relating thereto (photos in particular).

After this period and failing to comply with these formalities, the Products will be deemed to be compliant and free from any apparent defect and no complaint can be validly accepted by the Seller.

The Seller will reimburse or replace as soon as possible and at its expense, the Products delivered whose lack of conformity or apparent or hidden defects have been duly proven by the Customer, under the conditions provided for in Articles L 217-4 and following of the Consumer Code and those provided for in these T&Cs.

The transfer of the risks of loss and deterioration relating thereto will only be carried out when the Customer takes physical possession of the Products.

The Products therefore travel at the Seller's risk and peril except when the Customer has chosen the carrier himself.

As such, the risks are transferred at the time of delivery of the goods to the carrier.


Article 6 - Transfer of ownership



​The transfer of ownership of the Products from the Seller to the Customer will only take place after full payment of the price by the latter, regardless of the date of delivery of the said Products.


Article 7 - Right of withdrawal



​ Right of withdrawal is 14 days for non-personalized products sold online.

Returns must be made in their original condition and complete (packaging, accessories, instructions, etc.) allowing them to be resold in new condition, accompanied by the purchase invoice.

Damaged, soiled or incomplete Products are not taken back.

For personalized items the right of withdrawal does not apply. Return costs remain the responsibility of the Customer.

The exchange (subject to availability) or refund will be made within 14 days of receipt by the Seller of the Products returned by the Customer under the conditions provided for in this article.


Article 8 - Complaints


If the services ordered are in conformity at the time of delivery, it is obviously not up to the company Les Trésors de Mamie to make free alterations thereafter.

Disputes that may arise are as far as possible settled amicably between the parties concerned.

In the absence of amicable agreements, only the French courts will have jurisdiction to rule on all disputes that may arise between the parties relating to the execution of these presents.

Claims give rise to compensation taking into consideration the age and state of wear of the garment.

The Customer is informed that he may in any case resort to conventional mediation, with existing sectoral mediation bodies or to any alternative dispute resolution method (conciliation, for example) in the event of a dispute.

All disputes to which the purchase and sale transactions concluded in application of these GCS and which have not been the subject of an amicable settlement between the seller or by mediation, will be submitted to the competent courts under the conditions of law. commmon.


Article 9 - Company liability (textiles, skins, leather and suede)


When the designer's liability is engaged, the amount of reimbursement for articles is calculated on the basis of the reimbursement scale shown below and to which reductions are applied according to the obsolescence of the article.

The refund is equal to:

80% for an item purchased less than three months ago.

60% for an item purchased less than 30 months ago.

However, when the garment or article is returned, when the customer has made a declaration of value greater than that appearing in the reimbursement scale, it is the latter which will be taken into consideration on proof.

For older items, the refund is equal to 30% of the amount appearing in the scale and for an item that is obviously very used, the designer has the possibility of expressing reservations on the deposit receipt for the item.


Article 10 - Personal data



​The Customer is informed that the collection of his personal data is necessary for the sale of the Products and their delivery/delivery, entrusted to the Seller.

These personal data are collected only for the execution of the sales contract.

​10.1 Collection of personal data

​The personal data collected on the site www.lestresorsdemamie.com are as follows:

When creating the Client / user account: Surnames, first names, postal address, telephone number and e-mail address.

Payment

​10.5 Data retention period

​The Seller will keep the data thus collected for a period of 5 years, covering the time of the prescription of the applicable contractual civil liability.

​10.6 Security and privacy

​The Seller implements organizational, technical, software and physical digital security measures to protect personal data against alteration, destruction and unauthorized access.

However, it should be noted that the Internet is not a completely secure environment and the Seller cannot guarantee the security of the transmission or storage of information on the Internet.

​10.7 Implementation of Customer and user rights

Pursuant to the regulations applicable to personal data, Customers and users of the site www.lestresorsdemamie.com have the following rights:

The Customer may be asked to tick a box under which he agrees to receive informative and advertising e-mails from the Seller.
